HOMS were appointed as exclusive advisors to the Private Security Authority in 2005. The firm advised extensively in respect of the establishment of the licensing regime by the Authority and have drafted all required PSA regulations to date. 2007 proved a very successful year for the enforcement arm of the Authority with the Authority represented by HOMS having successfully obtained:
- Seven prosecutions for advertising the provision of a security service without being the holder of a licence;
- Nineteen prosecutions for the provision of services as a security guard (static) without being the holder of a licence;
- One prosecution for the provision of services as an installer intruder alarm without being the holder of a licence.
H. Pat Barriscale, head of our Litigation Department, foresees a continued focus on enforcement in the security industry in 2008 and stresses that all employers and providers should continue to be cognisant of their obligations under the Private Security Services Act 2004.
