Examinership in the Circuit Court

The Minister for Jobs, Enterprise and Innovation, Richard Bruton T.D., announced on October 11th, 2013 that it is planning new legislation to allow examinership applications to be heard in the Circuit Court in a bid to reduce the costs associated with the process. Currently SMEs are unable to gain the benefits of examinership due to the high costs involved in this High Court process. This new legislation seeks to allow SMEs to take a lower cost examinership route in the Circuit Court so that they can take advantage of the protection of examinership, enabling them to continue trading, restructure debts and continue providing employment.
